1. Introduction

Welcome to Sound Jams! Sound Jams is an application designed for creating, participating in, and sharing creative content, specifically audio-related "jams" and "submissions." By accessing or using Sound Jams, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the application.

2. User Accounts

To access certain features of Sound Jams, you may be required to create a user account. You agree to provide accurate and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

3. User Content

Sound Jams allows you to create, upload, and share various types of content, including text, images, audio files, and links to external videos (such as YouTube). You retain ownership of any intellectual property rights that you hold in the content you create and upload to Sound Jams ("User Content"). By submitting User Content, you grant Sound Jams a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, distribute, and prepare derivative works of your User Content in connection with the operation and promotion of the application.

By uploading content, you represent and warrant that you own all necessary rights, licenses, and permissions to the User Content and that your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party. We utilize content filtering, including using Google's API, to prevent the upload of inappropriate images.

4. Prohibited Conduct

You agree not to use Sound Jams for any unlawful or prohibited activities, including but not limited to:

Uploading or sharing content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
Engaging in harassment, spamming, or any form of unsolicited communication.
Infringing upon the intellectual property rights or other rights of others.
Attempting to gain unauthorized access to the application or other users' accounts.
Distributing viruses or other harmful code.

While we aim to be a platform for all ages, we reserve the right to moderate or remove content that we deem inappropriate. Future updates may include features for marking content as mature or requiring age verification for certain types of uploads.

5. Jams and Submissions

Sound Jams allows users to create and participate in "Jams," which are creative events or contests. Users can submit "Submissions" (entries) to these Jams, which may include audio, images, text, and linked videos, according to the rules and requirements set by the Jam creator. Participation in Jams and the nature of Submissions are governed by these Terms of Service and any specific rules outlined by the Jam creator.

6. Interactions

Sound Jams facilitates user interactions through features such as messaging, commenting on submissions, and sharing Jams and Submissions. You agree to engage in these interactions respectfully and in accordance with these Terms of Service.

7. Intellectual Property

All intellectual property rights in the Sound Jams application, including its design, features, and underlying technology, are owned by Sound Jams or its licensors. You may not copy, modify, distribute, sell, or lease any part of the Sound Jams application or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

8. Disclaimers and Limitation of Liability

Sound Jams is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. We do not warrant that the application will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, Sound Jams shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the application; (b) any conduct or content of any third party on the application; or (c) unauthorized access, use, or alteration of your transmissions or content.

9. Termination

We may suspend or terminate your access to Sound Jams at any time, for any reason, including if we believe you have violated these Terms of Service. Upon termination, your right to use the application will immediately cease.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any changes by posting the new Terms of Service on this page. Your continued use of the application after any such changes constitutes your acceptance of the new Terms of Service.
